SCFA CONSTITUTION
SIERRA COLLEGE FACULTY ASSOCIATION CONSTITUTION Article I: Name The name of this organization shall be the Sierra College Faculty Association (hereinafter referred to as "SCFA"). Article II: Purpose And Responsibility Section 1. The purposes of SCFA shall be: (a) to act as the exclusive bargaining agent for all faculty of Sierra College; (b) to promote an open and democratic system for representing Sierra College faculty; (c) to work for the common welfare of all Sierra College faculty. Section 2. It is the responsibility of SCFA to represent all Sierra College Full-time and Part-time faculty (hereinafter referred to as the Faculty) in any matters related to collective bargaining. Article III: Membership Section 1. All faculty employed by Sierra College are eligible to become members of SCFA . Membership in SCFA shall require and include concurrent membership in the Community College Association (CCA), the California Teachers' Association (CTA), and the National Education Association (NEA). Section 2. Eligibility for voting is established by being a member in good standing of SCFA . Such members, and only such members, may vote is all elections, polls, or Constitutional revisions or amendments conducted by SCFA. Section 3. The President of SCFA shall be a Full-time faculty member and the Vice-President of SCFA shall be a Part-time faculty member. The President and the Vice-President shall be elected by majority vote of all faculty members casting votes. To facilitate the effective representation of those interests which uniquely affect Full-time faculty and those interests which uniquely affect Part-time faculty, Full-time faculty shall elect four (4) Representatives and Part-time faculty shall elect four (4) Representatives to serve on the Executive Board of SCFA. Article IV: Executive Board Section 1. The Executive Board shall consist of the President, the Vice-President, four (4) Full-time Representatives and four (4) Part-time Representatives. The primary function of Executive Board members shall be to represent all members of SCFA in matters of collective bargaining. Moreover, the Executive Board shall: (a) Determine the negotiation priorities of SCFA and; (b) Appoint a negotiations team to achieve those priorities. Section 2. The duly elected Executive Board shall select its own Secretary and Treasurer and establish its own meeting times. Section 3. The Executive Board shall appoint at least one (1) Full-time and one (1) Part-time faculty member to its Negotiations Team. Section 4. As is consistent with CCA/CTA/NEA policies, there shall be a separate dues structure based on pay differentials between Full-time and Part-time faculty . However, there shall be only one (1) treasury. Section 5. A quorum of the Executive Board shall be at least two (2) Full-Time Representatives and two (2) Part-Time Representatives. Section 6. All decisions and appointments by the Executive Board shall be by a majority of the Representatives voting. Article V: Voting And Ratification Section 1. All voting by the members shall be by secret ballot. Unless otherwise provided for in this Constitution or the By-Laws, all issues shall be decided by a simple majority of the ballots cast. Section 2. Local dues and assessments for both Full and Part Time Faculty shall be established by the Executive Board and ratified by a vote of the membership Section 3. Full-time members and Part-time members shall separately ratify every contract proposal. To be included in the contract, a proposal must be approved by a majority of Full-time members casting votes and a majority of Part-time members casting votes.. Article VI: Relationship to Faculty Senate Section 1. SCFA may designate the Faculty Senate as its representative on those issues about which either Full-time or Part-time faculty has the legal right to confer. Section 2. SCFA shall make every effort to work with the Faculty Senate on overlapping issues that come under the purview of both the SCFA and the Faculty Senate. Article VII: Amendments This Constitution may be amended by a two-thirds (2/3) vote of the voting Full-time Members and a two-thirds (2/3) vote of voting Part-time Members.
